DFS EXPRESSLY DISCLAIMS ANY AND ALL (1) WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, OR FITNESS FOR A PARTICULAR PURPOSE; AND (2) WARRANTIES THAT THE SPECIFICATIONS DO NOT INFRINGE ANY THIRD PARTY PATENTS, COPYRIGHTS, TRADEMARKS, TRADE SECRETS, KNOW HOW OR OTHER INTELLECTUAL PROPERTY RIGHTS.

UNDER NO CIRCUMSTANCES SHOULD DFS APPROVAL, WHEN GRANTED, BE CONSTRUED TO IMPLY ANY ENDORSEMENT OR WARRANTY REGARDING THE FUNCTIONALITY, QUALITY, OR PERFORMANCE OF ANY PARTICULAR PRODUCT OR SERVICE, AND VENDOR SHALL NOT STATE OR IMPLY ANYTHING TO THE CONTRARY. DFS SPECIFICALLY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES WITH RESPECT TO PRODUCTS AND SERVICES THAT HAVE RECEIVED APPROVAL AND TO THE APPROVAL PROCESS GENERALLY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PURPOSE OR ALL RIGHTS AND REMEDIES RELATING TO PRODUCTS AND SERVICES THAT HAVE RECEIVED DFS TYPE APPROVAL ARE PROVIDED SOLELY BY THE PARTIES SELLING OR OTHERWISE PROVIDING SUCH PRODUCTS OR SERVICES, AND NOT BY DFS, AND DFS ACCEPTS NO LIABILITY WHATSOEVER IN CONNECTION WITH SUCH PRODUCTS AND SERVICES. UNLESS OTHERWISE AGREED IN WRITING BY DFS. THIS DOCUMENT AND MATTER CONTAINED HEREIN, INCLUDING ALL PRODUCTS AND SERVICES CONTEMPLATED BY THIS DOCUMENT ARE PROVIDED ON AN "AS-IS" BASIS, "WITH ALL FAULTS" AND WITH NO WARRANTIES WHATSOEVER, AND DFS SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PURPOSE, OR NONINFRINGEMENT.

This list and all information contained therein is confidential and subject to the confidentiality restrictions and obligations contained in your Agreement with Discover and the corresponding Operating Regulations. This list only contains contactless Tap on Mobile products that have been type approved by Discover. Discover may revoke a product's type approval at any time. Discover does not warrant any products or services provided by third parties. Discover's type approval does not, under any circumstances, include or imply any guarantees, assurances or warranties that a product that has received approval by Discover will operate in all possible settings or in connection with any other product that has received an approval by Discover. Discover's type approval does not, under any circumstances, include any endorsement or provide any warranty regarding the functionality, quality or performance of any particular product or service. Type approval by Discover does not, under any circumstances, include or imply any product warranties from Discover, including, without limitation, any implied WARRANTIES OF MERCHANTABILITY, FITNESS FOR PURPOSE, OR NON-INFRINGEMENT, all of which are expressly disclaimed by Discover. All rights and remedies regarding products and services that have received type approval by Discover shall be provided by the party providing such products or services and not by Discover.
